The following article analyzes the process of conception, elaboration, and adoption of the Universal Declaration of Bioethics and Human Rights, and reflects on the lessons it might hold for public bioethics on the international level. The author was involved in the process at a variety of levels: he provided advice to the IBC on behalf of the President's Council of Bioethics; he served as the U.S. representative to UNESCO's Intergovernmental Bioethics Committee; and led the U.S. Delegation in the multilateral negotiation (...) of Government experts that culminated in the adoption of the declaration in its final form. The moral, legal, and public policy dispute over embryonic stem cell research is the most prominent issue in American public bioethics of the past decade. The primary moral question raised by the practice of embryonic stem cell research is whether it is defensible to disaggregate living human embryos in order to derive pluripotent cells for purposes of basic research that may someday yield regenerative therapies. This essay will explain the legal and political dimensions of the embryonic stem cell debate as (...) it has unfolded at the national level in the United States, contrasting the position and thinking of President Clinton’s administration with that of George W. Bush. Building upon this, a set of brief reflections is offered on the form and substance of the American federal approach to this public matter, and whether it is ultimately sustainable to join the issue in this particular way. Public education is not just a way to organise and fund education. It is also the expression of a particular ideal about education and of a particular way to conceive of the relationship between education and society. The ideal of public education sees education as an important dimension of the common good and as an important institution in securing the common good. The common good is never what individuals or particular groups want or desire, but always reaches beyond such particular (...) desires towards that which societies as a whole should consider as desirable. This does, of course, put the common good in tension with the desires of individuals and groups. Neo-liberal modes of governance have, over the past decades, put this particular educational set up under pressure and have, according to some, eroded the very idea of the common good. This set of contributions reflects on this state of affairs, partly through an exploration of the idea of publicness itself – how it can be rearticulated and regained – and partly through reflections on the current state of education in the ‘north’ and the ‘south.’. Background Although the importance of clinical ethics in contemporary clinical environments is established, development of formal clinical ethics services in the Australia health system has, to date, been ad hoc. This study was designed to systematically follow and reflect upon the first 18 months of activity by a newly established service, to examine key barriers and facilitators to establishing a new service in an Australian hospital setting. Methods: how the study was performed and statistical tests used A qualitative case study (...) approach was utilised. The study gathered and analysed data using observations of service committee meetings, document analysis of agendas and minutes, and semi-structured interviews with committee members to generate semantic themes. By interpreting the thematic findings in reference to national capacity building resources, this study also aimed to provide practice-based reflections for other health agencies. Results: the main findings An overarching theme identified in the data was a strong commitment to supporting clinicians facing difficult patient care decisions and navigating difficult discussions with patients and families. Another key theme was the role of the new clinical ethics support service in providing clinicians with a pathway to raise system-wide issues with the organisation Executive. While there was strong clinical engagement, consumer and community participation remained a challenge, as did unresolved governance issues and a need for clearer policy relationship between the service and the organisation. Conclusions: brief summary and potential implications Considering these themes in relation to the national capacity building resources, the study identifies three areas likely to require ongoing development and negotiation. These are: the role of the clinical ethics support service as a link between the workforce and the Executive; the incorporation of consumers and patients; and ethical reasoning. To improve the effectiveness of the service, it is necessary to increase clarity on the service’s role at the governance and policy level, as well as develop strategies for engaging consumers, patients and families. Finally, the capacity of the service to reflect on complex cases may be enhanced through explicit discussions of various different ethical frameworks and ways of deliberating. (shrink)

In non‐literal uses of language, the content an utterance communicates differs from its literal truth conditions. Loose talk is one example of non‐literal language use (amongst many others). For example, what a loose utterance of (1) communicates differs from what it literally expresses: (1) Lena arrived at 9 o'clock. Loose talk is interesting (or so I will argue). It has certain distinctive features which raise important questions about the connection between literal and non‐literal language use. This paper aims to (i.) (...) introduce a range of novel data demonstrating certain overlooked features of loose talk, and (ii.) develop a new theory of the phenomenon which accounts for these data. In particular, this theory is motivated by the need to explain minimal pairs such as (2)-(3): (2) Lena arrived at 9 o'clock, but she did not arrive at 9 o'clock exactly. (3) ?? Lena did not arrive at 9 o'clock exactly, but she arrived at 9 o'clock. (2) and (3) agree in their truth conditions. Yet they differ in felicity. As such, they constitute a problem for any account which hopes to predict the acceptability of the loose use of a sentence from its truth conditions and the context of utterance alone. Instead, it will be argued, to explain loose talk phenomena we must posit an additional layer of meaning outstripping truth conditions. This layer of meaning is shown to exhibit a range of properties, all of which point to its being semantically encoded. Thus, if correct, the theory provides a new example of how semantic meaning must extend beyond literal, truth‐conditional content. (shrink)

Although much evidence indicates that young infants perceive unitary objects by analyzing patterns of motion, infantsÕ abilities to perceive object unity by analyzing Gestalt properties and by integrating distinct views of an object over time are in dispute. To address these controversies, four experiments investigated adultsÕ and infantsÕ perception of the unity of a center-occluded, moving rod with misaligned visible edges. Both alignment information and depth information affected adultsÕ and infantsÕ perception of object unity in similar ways, and infants perceived (...) object unity by integrating information about object features over time. However, infants perceived a moving, misaligned, three-dimensional object as indeterminate in its connectedness, whereas adults perceived it as connected behind the occluder. These findings indicate that the effectiveness of common motion in specifying unified surfaces across an occluder is reduced by misalignment of edges. Alignment information enhances perception of object unity either by serving directly as information for unity or by optimizing the detectability of motion-carried information for unity. In addition, young infants are able to retain information about edge orientation over short intervals in determining connectedness via a process of spatiotemporal integration. ABSTRACT In a recent paper Alan Carter argues that the claim that workers’co‐operatives merely replace exploitation by employers with ‘self‐exploitation’is nonsense: the term ‘self‐exploitation’is self‐contradictory. He maintains that the only form of exploitation to which a workers’co‐operative may be said to be subject is ‘market‐exploitation’by dominant economic actors who are external to the co‐operative. I argue that these conclusions are mistaken. While the concept of ‘market‐exploitation’is not without value, it is difficult to operationalise. While the concept of ‘self‐exploitation’is, understood (...) literally, incoherent, the claims defended by some of the users of this term can be made conceptually respectable. (shrink)

This fully revised new edition re-establishes Paul Griffiths's survey as the definitive study of music since the Second World War. The disruptions of the war, and the struggles of the ensuing peace, were reflected in the music of the time: in Pierre Boulez's radical reforming of compositional technique and in John Cage's move into zen music, in Milton Babbitt's settling of the serial system and in Dmitry Shostakovich's unsettling symphonies, in Karlheinz Stockhausen's development of electronic music and in Luigi Nono's (...) pursuit of the universally human, in Iannis Xenakis's view of music as sounding mathematics and in Luciano Berio's consideration of it as language. The initiatives of these composers and their contemporaries opened prospects that have continued to unfold. This constant expansion of musical thinking since 1945 has left us with no single history of music. Paul Griffiths's study accordingly follows several different paths, showing how and why they converge and diverge. In addition to the composers mentioned above, others whose music is discussed include Steve Reich, Jean Barraque, Elliott Carter, Olivier Messiaen, Gyorgy Kurtag, Harrison Birtwistle, and Gyorgy Ligeti. The Discourses of Epictetus were first translated into English by Mrs. Elizabeth Carter in 1758. This translation was rewritten in 1865 by an American, Thomas W. Higginson. In 1890 Bohn’s Classical Library issued a translation with notes and a life of Epictetus by George Long. Like Higginson, Long began by attempting a revision of Mrs. Carter’s version, and then decided to make his own translation, which he later compared with Mrs. Carter’s and with the Latin version. How does an object persist through change? How can a book, for example, open in the morning and shut in the afternoon, persist through a change that involves the incompatible properties of being open and being shut? The goal of this reader is to inform and reframe the philosophical debate around persistence; it presents influential accounts of the problem that range from classic papers by W. V. O. Quine, David Lewis, and Judith Jarvis Thomson to recent work by contemporary philosophers. (...) This study addresses the nature of the contribution made by Christian feminist thinkers who claim that mutuality is a necessary part of a Christian social ethical framework. The theological method employed is analytical and comparative toward the end of illuminating, testing, and demonstrating the thesis: mutuality is a formal norm for Christian social ethics that functions along with love and justice to promote a balance of power that is required for optimum human flourishing, a flourishing set within the interdependent context (...) of the whole of creation. ;Chapter One analyzes selected primary sources of Rosemary Radford Ruether, Carter Heyward, Beverly Wildung Harrison, and Elizabeth A. Johnson isolating their definition and treatment of the term, "mutuality." A consensus definition of mutuality drawn from definitions by the four feminists. It is concluded that, similar to the tripartite nature of justice, mutuality has four forms--cosmic, gender, generative, and social. ;Chapters Two and Three illustrate several moments in the history of Christian thought wherein antecedents of the feminists' notion of mutuality are found. Selected primary works of Thomas Aquinas, John Duns Scotus, Martin Buber, and H. Richard Niebuhr are examined. ;Chapter Four compares the four feminists' definition of mutuality with definitions of formal norm by Josef Fuchs, Lisa Sowle Cahill, and Timothy E. O'Connell, determining that mutuality is a formal norm for Christian social ethics. Chapter Five is a case study. Utilizing our definition, it is shown how consideration of mutuality and its four forms influences the ethical analyses of George Weigel, Jean Bethke Elshtain, and Stanley Hauerwas in determining if the Persian Gulf War was a just war. It is concluded that the probative value of the formal norm, mutuality, is multifaceted. First and foremost, it requires the moral agent to deal concretely in moral reflection and moral decision-making. Specific and careful attention needs to be given to the reality revealing questions in the concrete, as well as in the abstract. Second, mutuality requires the moral agent to probe the dynamics of power in an ethical dilemma and to seek out ways to shape those dynamics to serve power-with. It is a complement to and corrective of love and justice. Third, engaging the norm of mutuality presses the moral agent toward inclusivity drawing into the process of moral reflection concern for the thriving and flourishing of all involved. More than the norms of love and justice, mutuality places humans in a perspective within the whole of creation. (shrink)
